Affiliates Terms and Conditions

Thank you for your interest in becoming an affiliate of Mindful Designs Haven. These terms and conditions (“Agreement”) govern your participation in our affiliate program. By registering as an affiliate, you agree to abide by the terms and conditions outlined below.

1. Affiliate Registration and Approval

  • To participate in the Mindful Designs Haven Affiliate Program, you must submit a complete application through our registration process. We reserve the right to approve or reject any application at our sole discretion.
  • By applying, you confirm that you are at least 18 years old and that all information provided during registration is accurate and complete.

2. Affiliate Responsibilities

  • As an affiliate, you agree to promote our website, products, and services in a lawful, ethical, and responsible manner. All promotional efforts must be made in good faith and align with our values and brand image.
  • Affiliates are required to ensure that all advertising and promotional materials used comply with applicable laws and regulations, including but not limited to advertising and data protection laws.
  • Any misuse of affiliate links, including misleading claims, false advertising, or unauthorized use of Mindful Designs Haven’s branding, may result in the immediate termination of your affiliate standing.

3. Prohibited Activities

Affiliates must not engage in the following activities:

  • Unlawful Behavior: Affiliates must not use illegal tactics, including but not limited to spamming, posting misleading claims, or using deceptive practices to generate traffic or sales.
  • Trademark Violations: Affiliates must not use Mindful Designs Haven’s trademarks, logos, or any other intellectual property without prior written consent, except as provided for within this Agreement for the purpose of affiliate promotion.
  • Inappropriate Content: Affiliates must not use websites, content, or marketing materials that contain or promote hate speech, discrimination, violence, illegal activity, or otherwise inappropriate content.

4. Commissions and Payments

  • Affiliates will earn commissions for eligible sales generated through their unique affiliate links. Eligible sales exclude cancellations, refunds, and returns.
  • Commission rates and structures are determined at the time of your registration and are subject to change. We will provide notice of any changes in commission rates via email or our affiliate dashboard.
  • Payment terms may be adjusted based on Mindful Designs Haven’s discretion, and all payments are subject to verification of sales.
  • Commissions will be paid out on a periodic basis, typically via PayPal. There will be a threshold for payout (minimum payout amount).

5. Changes to the Affiliate Program

  • Mindful Designs Haven reserves the right to modify or discontinue the Affiliate Program, including commission rates, payment terms, or eligibility criteria, at any time with prior notice. Affiliates will be notified of any material changes to the program, and continued participation in the program after such changes will constitute acceptance of the updated terms.

6. Affiliate Termination

  • Mindful Designs Haven reserves the right to terminate your affiliate standing at any time, with or without cause, at its sole discretion. Reasons for termination may include, but are not limited to:
    • Violation of these terms and conditions.
    • Failure to promote Mindful Designs Haven in a lawful and ethical manner.
    • Engaging in any activities that damage our reputation or business.
  • Upon termination, you must immediately cease using any promotional materials containing Mindful Designs Haven branding and remove all affiliate links from your platforms.

7. Affiliate Relationship

  • The relationship between Mindful Designs Haven and affiliates is purely contractual. Affiliates are independent contractors and not employees, agents, or representatives of Mindful Designs Haven. You have no authority to make any representation, claim, or commitment on behalf of Mindful Designs Haven.

8. Liability and Indemnification

  • Mindful Designs Haven will not be liable for any direct, indirect, or consequential damages resulting from your participation in the Affiliate Program. You agree to indemnify and hold harmless Mindful Designs Haven, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your breach of this Agreement, unlawful activities, or improper promotion of our products and services.

9. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from this Agreement will be resolved in the courts of our choosing.

10. Privacy Policy

  • As an affiliate, you agree to comply with all applicable privacy and data protection laws when collecting and processing personal data, and you will not misuse any data obtained through our Affiliate Program. Please refer to our Privacy Policy for more information.
